By accessing and using the Sprout mobile application and related services (collectively, "Sprout"), you agree to comply with and be bound by these Terms of Use. If you do not agree to these terms, please do not use Sprout.
2. Description of Service
Sprout is a mental wellness app offering positive psychology interventions, mood tracking, and personalized activity plans. The service includes access to various features and content designed to promote mental well-being.
3. User Registration
You may be required to register and create an account to use certain features of Sprout. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
4. Eligibility
Users must be at least 13 years of age to use Sprout. If you are under 18 years old, you must have the consent of a parent or guardian to agree to these Terms of Use and use Sprout.
5. User Conduct
You agree to use Sprout only for lawful purposes. You are prohibited from posting or transmitting any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, or otherwise objectionable material of any kind.
6. Intellectual Property
All content, trademarks, service marks, trade names, logos, and icons are proprietary to Sprout. Nothing contained in Sprout should be construed as granting any license or right to use any trademark displayed on the application without the written permission of Sprout or such third party that may own the trademarks.
7. Subscription and Payment
Sprout offers subscription plans for individual users and corporations. By subscribing, you agree to pay the applicable subscription fees and any related taxes. Fees are non-refundable except as required by law.
8. Termination
Sprout reserves the right to terminate or suspend your account and access to the service at its sole discretion, without notice and liability, for conduct that Sprout believes violates these Terms of Use or is harmful to other users of the service, Sprout, or third parties, or for any other reason.
9. Limitation of Liability
In no event shall Sprout be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use Sprout; (ii) any conduct or content of any third party on the service.
10. Disclaimer: No Medical or Psychiatric Advice or Therapy
Sprout is not a medical or health services provider and does not engage in patient diagnosis or the practice of medicine. The content and member content presented through the app and services are not intended as medical or psychiatric advice or therapy. They are not provided to diagnose or treat medical or psychiatric conditions and are not a substitute for professional medical or psychiatric treatment or therapy. The app and services should never replace the advice of a licensed healthcare provider or medical professional. Using the app and services does not establish a doctor-patient relationship. While communications between you and Sprout are covered by our privacy policy, they are not protected by physician-patient privilege or doctor-patient confidentiality. All content and member content available through the app and services should be discussed and confirmed with your physician, psychiatrist, therapist, or other healthcare provider before adopting any wellness program, exercise program, or other treatment, whether offered on the app or through the services. Using the app, services, content, and member content is at your own risk. Information and statements regarding some products and services featured through the app and services have not been evaluated by the Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease or psychological disorder.
11. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
12. Changes to Terms
Sprout reserves the right, in its sole discretion, to modify or replace these Terms of Use at any time. Your continued use of Sprout following the posting of any changes to the Terms of Use constitutes acceptance of those changes.
